Consumer Agreement
By using and making a purchase with Santa Called Me you agree to all Terms and Conditions. These Terms and Conditions can change any time without notice. 

Santa Called Me only uses PayPal to make a purchase. Santa Called Me reserves the right to not accept any orders. 
When you schedule your time for your phone call with Santa Called Me, you are reserving your allotted time for your Santa Call. Santa Called Me can only accept a certain number of orders for each time slot. When you reserve your date and time, that is time Santa Called Me cannot schedule. Therefore, if you cancel, don't answer, or need to reschedule there are penalties (which are named below). This is because Santa Called Me could not schedule calls for the time reserved for you.

No Answer
When making a purchase through Santa Called Me, you agree to the date and time you have selected. If Santa Called Me calls you on the date during the time you have selected, and there is no answer, Santa Called Me will try one more time during the scheduled time. If there is no answer, Santa Called Me will leave you a message, and record a personalized message and email it to the email address on file.
There will be a $5.00 charge for every time Santa Called Me attempts to make your phone call. Santa Called Me has the right to call the phone number you gave us any time during your scheduled time. 

Rescheduling
If you ask to reschedule your Santa Call, and your call is more then 24 hours away, you will be charged $10.00 (per child) to change the date and/or time, plus be required to pay the difference in price (if there is a difference), before the phone call is placed If you ask to reschedule your Santa Call, and your call is less then 24 hours away, you will be charged $15.00 (per child) to change the date and/or time, plus be required to pay the difference in price (if there is a difference) before the phone call is placed.

Canceling Your Order
If you cancel your order with Santa Called Me (for whatever reason) and you request a refund, Santa Called Me will keep 75% of the total price of the phone call and you will only be issued 25% of the total price of the order (for calls scheduled between November 25, 2011 and December 15, 2011). If you cancel your order with Santa Called Me (for whatever reason) and you request a refund, Santa Called Me will keep 80% of the total price of the order and you will only be issued 20% of the total price of the phone call (for calls scheduled between December 16, 2011 and December 24, 2011). 

Santa Reminder Form
Santa Called Me communicates via email (by either your email address through PayPal, or the one provided to Santa Called Me on the "Santa Reminder Form". If you do not see any emails sent by Santa Called Me (info@SantaCalledMe.com) check your SPAM filter. Santa Called Me is not responsible for any emails that were in your SPAM filter. 

After you are done paying through PayPal for your order you will directed back to Santa Called Me. In your email you will have two things. A payment receipt from PayPal, and an email from Santa Called Me to confirm your email address. After confirming your email address you will receive a link to the Santa Reminder Form. You will have 24 hours after your order is placed to fill out this form. If Santa Called Me does not receive the Santa Reminder From before your call, Santa Called Me cannot make the phone call. However if there is a phone number on file (either from the previous year, or from PayPal, Santa Called Me will attempt to make the phone call with that phone number). Santa Called Me will record a message and email the message to the email address on file. If you wish to reschedule you may be asked to pay the difference in price (if there is a difference), before the phone call.

Caller ID
When Santa Called Me calls you, Santa Called Me does make the attempt for the Caller ID to display, "North Pole". If caller ID does display "North Pole" it will be where the name normally is. There will still be a phone number on the caller ID. The "North Pole" caller ID will not work with cell phones, or phones that do not have the name is the caller ID display. Santa Called Me does guarantee that the caller ID will display, "North Pole". Some phone companies do not allow "North Pole" to show on the caller ID. This is beyond the control of Santa Called Me. We place the value of the caller ID displaying "North Pole" at $1.00 if in the unlikely event that the caller ID does not display North Pole please contact us within 24 hours of your call, and we will issue you the refund of $1.00 (the value we place on the Caller ID displaying North Pole). Santa Called Me will not issue a refund for the Caller ID if the phone number was for a cell phone. If Santa Called Me places the call, and talks to the children (that an adult has paid for), and you request a full refund for any reason, Santa Called Me will not issue any full refunds. Because you have received the service of Santa Called Me, no full refunds will be honored. 

Call Times
Santa Called Me writes all times in Eastern Standard Time (EST). All times on the website, emails, and "Santa Reminder Form" are EST. Santa Called Me can place your call anytime during the time you selected. For example, if you select 7:00pm- 9:59pm EST Santa Called Me has until 9:59pm EST to place your call. If you missed your call, do not call the number back. Write Santa Called Me an email at info@SantaCalledMe.com, with your name, and date and time you missed your phone call. 

Phone Call Recording
Santa Called Me records every outgoing phone call. This is for the protection of both Santa Called Me, and it's customers. We put the value of the recording of $6.95.

Shipping & Delivery
At this time, Santa Called Me ships merchandise only to locations within the United States and Canada. The risk of loss and title for all merchandise ordered on this Web site pass to you when the merchandise is delivered to the shipping carrier. 

After the call is placed, Santa Called Me will email you (within 24 hours) a link where you can download your phone call. The email address will be the same email address that you confirmed when placing an order with Santa Called Me.

Return Policy
Santa Called Me does not accept returns.

VOID WHERE PROHIBITED: Although the information on this Web site is accessible worldwide, not all products or services discussed in this Web site are available to all persons or in all geographic locations or jurisdictions. Santa Called Me and the advertisers each reserve the right to limit the provision of their products or services to any person, geographic area, or jurisdiction they so desire and to limit the quantities of any products or services that they provide. Any offer for any product or service made in the materials on this Web site is void where prohibited. 

GOVERNING LAW: In the event of litigation both parties agree that the Law of shall apply and both parties consent to the jurisdiction of the state courts of, Michigan, or in the event of diversity of citizenship. Both parties expressly waive a trial by jury. 

MISCELLANEOUS: The Terms and Conditions constitute the entire agreement between you and Santa Called Me with respect to this Web site. The Terms and Conditions supercede all prior or contemporaneous communications and proposals, whether electronic, oral or written between you and Santa Called Me with respect to this Web site. No modification of the Terms and Conditions shall be effective unless it is authorized by Santa Called Me. If any provision of the Terms and Conditions is found to be contrary to law, then such provision(s) shall be constructed in a manner to closely reflect, as much as possible, the intentions of the parties, with the other provisions remaining in full force and effect.
